The present sales conditions are concluded firstly by the company SAS DJOULIA IMPORT whose registered office is located at 5 rue Ampère, 21110 Genlis, registered with the Trade and Companies Register under the number 850 323 890 000 10 and managing the site www.distri-emballage.com, and secondly by any individual or legal entity wishing to make a purchase through the website www.distri-emballage.com hereinafter referred to as "the buyer".
Article 1. Purpose
These sales conditions aim to define the contractual relationships between SAS DJOULIA IMPORT and the buyer and the conditions applicable to any purchase made through the website www.distri-emballage.com. The acquisition of a product through this site implies the buyer’s unreserved acceptance of these sales conditions, which the buyer acknowledges having read before placing their order. Before any transaction, the buyer declares that the purchase of products on the website www.distri-emballage.com is not directly related to their professional activity and is limited to personal use only, and further affirms having full legal capacity to engage under these general sales conditions. SAS DJOULIA IMPORT reserves the right to modify these sales conditions at any time to comply with new regulations or to improve the use of its site. Therefore, the applicable conditions will be those in effect on the date of the buyer's order.
Article 2. Products
The products offered are those listed on the website www.distri-emballage.com of the company SAS DJOULIA IMPORT, within the limits of available stock. SAS DJOULIA IMPORT reserves the right to modify the product range at any time. Each product is presented on the website with a description of its main technical characteristics. The photographs are as accurate as possible but do not bind the Seller in any way. The sale of the products presented on the website www.distri-emballage.com is intended for all buyers residing in countries that fully allow the entry of these products into their territory.
Article 3. Prices
The prices listed on the product sheets of the online catalog are in Euros (€), including all taxes (VAT). SAS DJOULIA IMPORT reserves the right to change its prices at any time, provided that the price listed in the catalog on the day of the order will be the only one applicable to the buyer. The indicated prices do not include delivery fees, which are charged in addition to the price of the purchased products based on the total amount of the order. In mainland France, for any order, a shipping fee of 1 euro for home delivery is offered and will be charged to the buyer.
Article 4. Order and Payment Methods
Before placing an order, the buyer must create an account on the website www.distri-emballage.com. The account creation section is directly accessible from the top menu bar in the "MY ACCOUNT" area. On each visit, if the buyer wishes to order or check their account (order status, profile…), they must log in with their information. SAS DJOULIA IMPORT offers the buyer the option to order and pay for their products in several stages, with 3 payment options to choose from:
• Payment by credit card: the buyer selects the products they wish to order in the "cart", modifies if necessary (quantities, references…), verifies the delivery address or enters a new one. Then, shipping fees are calculated and presented to the buyer, along with the name of the carrier. The buyer then chooses their preferred payment method: "Credit card payment". Finally, the last step allows them to review all the information, acknowledge and accept these general sales conditions by checking the corresponding box, and then invites them to confirm their order by clicking on the "ORDER" button. The buyer is then redirected to the secure interface to enter their personal credit card details securely. If the payment is accepted, the order is recorded and the contract is definitively formed. Payment by credit card is irrevocable. In case of fraudulent use of the card, the buyer can request cancellation of the card payment, and the amounts paid will then be credited or refunded. The cardholder’s liability is not engaged if the disputed payment is proven to have been made fraudulently, remotely, without physical use of the card. To obtain a refund of the fraudulent debit and any banking fees that the transaction may have incurred, the cardholder must dispute the debit in writing with their bank within 70 days of the transaction, or 120 days if the contract with the bank provides for it. The amounts debited are refunded by the bank within a maximum of one month after receipt of the written dispute from the cardholder. The buyer is then redirected to the secure PAYPAL interface to enter their Paypal account details securely. If the payment is accepted, the order is recorded and the contract is definitively formed. Payment by Paypal account is irrevocable.
• Payment by bank transfer: the buyer selects the products they wish to order in the "cart", modifies if necessary (quantities, references…), verifies the delivery address or enters a new one. Then, shipping fees are calculated and presented to the buyer, along with the name of the carrier. The buyer then chooses their preferred payment method: "Payment by bank transfer". Finally, the last step allows them to review all the information, acknowledge and accept these general sales conditions by checking the corresponding box, and then invites them to confirm their order by clicking on the "ORDER" button. This final click forms the definitive conclusion of the contract. Upon confirmation, the buyer receives an order summary confirming the registration of their order. To finalize their payment and trigger the processing of their order, the buyer must make the bank transfer using the provided bank details. Upon receipt of the transfer, the order will be processed, and the buyer will be informed by email. SAS DJOULIA IMPORT will ship the products at the earliest 2 working days after receiving the transfer corresponding to the order. Confirmation of an order implies acceptance of these sales conditions, acknowledgment of having full knowledge of them, and waiver of any claims regarding their own purchase conditions. All data provided and the recorded confirmation will serve as proof of the transaction. SAS DJOULIA IMPORT will send the buyer an email confirmation of their order registration. Article 5. Retention of Title
SAS DJOULIA IMPORT retains full ownership of the products sold until full payment of the price, including principal and fees.
Article 6. Right of Withdrawal
The consumer has a period of fourteen days to exercise their right of withdrawal from a distance contract, following a telephone solicitation or off-premises, without having to justify their decision or bear any other costs than those provided for in Articles L. 221-23 to L. 221-25. The period mentioned in the first paragraph starts from the day of receipt of the goods by the consumer or a third party, other than the carrier, designated by them, for contracts for the sale of goods. For contracts concluded off-premises, the consumer can exercise their right of withdrawal from the conclusion of the contract. In case of exercising the right of withdrawal within the aforementioned period, only the price of the purchased products and shipping costs will be refunded, return costs remain the Client’s responsibility. Returned products must be in their original and complete condition (packaging, accessories, instructions...); they should, if possible, be accompanied by a copy of the purchase receipt. Products returned incomplete, damaged, or soiled by the Client will not be accepted.

Article 7. Delivery
Deliveries are made to the address specified by the buyer on the order form. Delivery times are given for information purposes only. The company SAS DJOULIA IMPORT will not be held liable for any consequences due to a delay in delivery. Delivery will be considered complete when the buyer takes physical possession of the products. If the buyer is absent, a delivery notice will be left, allowing the buyer to collect the parcel from the post office. The buyer has a period of fifteen days from the date of the notice to retrieve their package. If the parcel is not picked up within this period, it will be returned to SAS DJOULIA IMPORT and the buyer will be reimbursed. Return costs will be borne by the buyer.
Article 8. Warranty
SAS DJOULIA IMPORT is not liable for the failure to comply with the regulations and laws in force in the receiving country, the buyer being solely responsible for checking with the local authorities the possibilities of importing or using the products they plan to order. The buyer is expressly informed that SAS DJOULIA IMPORT is only a distributor and is not the manufacturer of the products sold. Consequently, SAS DJOULIA IMPORT cannot be held liable for any defect or damage to the products caused by the manufacturer. The buyer can contact SAS DJOULIA IMPORT's customer service to obtain information on the application of warranties. The buyer must provide proof of the defects or anomalies observed, and SAS DJOULIA IMPORT will then decide whether to issue a credit note, replacement, or repair of the product.
Article 9. Liability
SAS DJOULIA IMPORT's liability is limited to the amount of the order.
